Terms of purchase and right of withdrawal

What is sold

The platform sells educational digital materials — guides, checklists, matrices and spreadsheets on the law and regulation of the energy sector. Each material page states the content, the file formats and the date up to which the material was updated.

Access

Access is released in your account as soon as the payment is confirmed and lasts 12 months from that confirmation. During that period you may read the material on its page and download the files as many times as you wish; the files are generated with the most recent version of the content.

Access is personal and tied to the account that made the purchase. The purchase grants an individual licence, for consultation and use in the buyer’s own work; reselling, redistributing, publishing or sharing the files is not permitted, since their reproduction and distribution depend on the author’s authorisation (art. 29 of Lei 9.610/1998, the Brazilian Copyright Act).

The files of paid materials carry a licence code in the footer (for example, EL-7F3A9-C21E4). The code is generated from the account and the material, contains no name, e-mail, CPF (Brazilian taxpayer number) or other personal data, and can only be linked to the purchase by the platform. It serves to identify redistributed copies; it does not technically prevent copying.

Download links are temporary (valid for 30 minutes) and access is checked at each use. To prevent automated extraction, a very high number of downloads in one hour may require a pause of a few minutes; this does not block the account, and support can review any case. The download log is never used, on its own, to deny the right of withdrawal.

Price and payment

Prices are in Brazilian reais (BRL) and are shown on each material page before purchase. Payment is made in the Mercado Pago environment, which processes the transaction; card data does not pass through the platform and is not stored by it.

The available payment methods — such as Pix (Brazil’s instant payment system) and credit card — and the instalment conditions are those shown in the Mercado Pago checkout at the time of purchase. The material is released after Mercado Pago confirms the payment; pending payments, such as an unpaid Pix, do not release access.

Right of withdrawal

For purchases made over the internet, you may withdraw within 7 (seven) calendar days from the confirmation of the purchase, without giving a reason, under art. 49 of the Brazilian Consumer Protection Code (Código de Defesa do Consumidor — Lei 8.078/1990). The amount paid is refunded in full, through the same payment method, and access to the material is ended.

To exercise this right, use the Right of withdrawal page (energylegal.com.br/arrependimento), the contact page or the same channel used for the purchase (art. 5, § 1, of Decreto 7.962/2013, the Brazilian e-commerce decree), stating the account e-mail and the material purchased. The request receives a protocol number; we confirm receipt right away and immediately notify Mercado Pago for the reversal; the time for the amount to appear on the statement depends on the card issuer.

Refunds after the withdrawal period

After the 7 (seven) days, there is no refund for simple withdrawal.

If the material has a problem — the payment was confirmed and the material does not appear in My Library, a file does not open or cannot be generated, or the content differs from what was advertised on the material page —, contact us through the contact page. We will fix the problem or, if that is not possible, refund the amount paid.

Payment disputes (chargeback)

If the cardholder disputes the charge with the card issuer or with Mercado Pago, the request goes under review. If the dispute is upheld and the amount is returned to the cardholder, access to the material is ended; if it is not upheld, access continues normally.

Jurisdiction

The consumer is guaranteed the right to bring proceedings in the courts of their domicile (art. 101, I, of the Brazilian Consumer Protection Code).

Personal data

The data needed for the purchase is processed in accordance with the Privacy Policy and the LGPD (Lei 13.709/2018, Brazil’s General Data Protection Law), only to release access, record the transaction and meet legal obligations.
